Terms of Service
These Terms of Service ("Terms") govern your use of the ORILO application and website (orilo.eu), operated by MONVADEL ("we", "us", "our").
By using ORILO, you agree to these Terms. If you do not agree, do not use the service.
1. Service Description
ORILO is a European digital communication ecosystem currently in private beta. The service includes end-to-end encrypted messaging and, in future phases, social networking, marketplace and mini-programme features. The service is provided as described on orilo.eu and in applicable release notes.
2. Eligibility
You must be at least 16 years of age to use ORILO. By creating an account, you confirm that you meet this requirement. We may require identity verification (KYC) for certain features.
3. Account Registration
You are responsible for maintaining the security of your account credentials. You must not share your account with others. You must notify us immediately at legal@monvadel.eu if you suspect unauthorised access to your account.
4. Acceptable Use
You agree not to use ORILO to:
- Transmit illegal content, including content that violates EU Directive 2008/913/JHA on combating racism and xenophobia
- Harass, threaten, or intimidate other users
- Distribute malware, phishing content, or fraudulent material
- Violate the intellectual property rights of others
- Attempt to circumvent our security measures or access systems without authorisation
- Create accounts for automated or bot activity without our prior written consent
- Violate any applicable law or regulation
5. Content
You retain ownership of content you create and share on ORILO. By sharing content, you grant MONVADEL a limited, non-exclusive licence to store and transmit that content as necessary to provide the service. We do not claim ownership of your content and do not use it for advertising purposes.
End-to-end encrypted content in the communication module cannot be accessed by MONVADEL. You are solely responsible for the content of encrypted communications.
6. Prohibited Content
You must not upload, share or transmit:
- Child sexual abuse material (CSAM) or any sexual content involving minors
- Content that incites violence or hatred against individuals or groups
- Malware, viruses, or malicious code
- Content that infringes third-party intellectual property rights
- False or misleading information intended to cause harm
Violations may result in immediate account termination and, where required by law, reporting to competent authorities.
7. Moderation and Appeals
We apply a tiered moderation model: automated detection, community moderation, and a Trust & Safety team. If content is removed or your account is restricted, you have the right to appeal within 24 hours. We will respond to appeals within 72 hours, in accordance with EU Digital Services Act requirements.
8. Service Availability
ORILO is provided in beta. We do not guarantee uninterrupted availability. We will provide reasonable notice of planned maintenance. We are not liable for losses arising from service interruptions beyond our reasonable control.
9. Subscription and Payments
Basic ORILO features are free. Premium features, where available, are offered on a subscription basis. Prices are displayed before purchase. You have a 14-day right of withdrawal from any subscription purchase, in accordance with EU Consumer Rights Directive (2011/83/EU). To exercise this right, contact legal@monvadel.eu.
10. Termination
You may delete your account at any time from within the application. We may suspend or terminate your account if you violate these Terms, with notice where practicable. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable law, MONVADEL is not liable for indirect, incidental, or consequential damages arising from your use of ORILO. Our total liability to you shall not exceed the amounts you have paid us in the 12 months preceding the claim.
12. Governing Law
These Terms are governed by the law of Romania. Disputes shall be subject to the jurisdiction of the competent courts of Romania, without prejudice to your rights as a consumer under the law of your country of residence within the EU.
13. Changes to These Terms
We will notify you of material changes at least 15 days before they take effect, via email or in-app notification. Continued use after that date constitutes acceptance.
